1. Acceptance of Terms

By accessing or using Vidify ("the Service"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.

2. Description of Service

Vidify is an AI-powered platform for creating promotional videos from websites, images, and media. Features include web scraping, AI-generated scripts and video clips, stock media search, image download from websites, voiceover, and project management.

3. User Responsibilities

3.1 Lawful Use

You agree to use the Service only for lawful purposes. You must:

• Copyright: Only use content (images, videos, text, logos) that you own or have explicit permission to use. Unauthorized use may violate copyright.
• Website scraping: Only fetch images from websites you own or have permission to scrape. Scraping third-party sites without permission may violate their Terms and applicable law.
• Not use the Service for impersonation, defamation, or illegal content.

3.2 API Keys

You are responsible for your API keys. We are not liable for any loss or misuse.

3.3 Content You Provide

You represent that you have the right to use all content you upload, and that it does not infringe third-party rights or contain illegal or harmful material.

4. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind.

• We do not warrant uninterrupted, error-free, or secure operation.
• AI-generated content may be inaccurate or unsuitable. You are solely responsible for reviewing all output.
• We do not warrant the quality, legality, or suitability of third-party content (stock images, videos, music).

5. Limitation of Liability

To the maximum extent permitted by law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.
• We are not liable for: third-party content; copyright claims; actions of third-party services (OpenAI, fal.ai, Pixabay, etc.); errors or downtime; loss of data; or your use of AI-generated content.

6. Indemnification

You agree to indemnify, defend, and hold harmless Vidify, its operators, and affiliates from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Content you upload or generate (including copyright infringement)
• Your use of images from websites (whether or not you had permission)
• Any claim that your use caused harm to a third party

7. Intellectual Property

You retain ownership of your content. We do not claim ownership of your videos or projects. The Service, its design and branding, are our property.

8. Third-Party Services

The Service integrates with third-party APIs (OpenAI, fal.ai, Pixabay, Pexels, etc.). Your use is subject to their terms. We are not responsible for the actions, content, or policies of any third party.

9. Termination

We may suspend or terminate your access at any time. We may modify or discontinue the Service. Upon termination, your right to use ceases immediately. We are not obligated to retain your data.

10. Governing Law

These Terms shall be governed by the laws of Hungary. Disputes shall be resolved in the courts of Hungary.

11. Severability

If any provision is unenforceable, the remaining provisions remain in effect.

12. Changes

We may modify these Terms. Continued use after changes constitutes acceptance.
